DISCLAIMER: By applying for membership with Charity Check, LLC (“Charity Check”) and/or accessing the Charity Check database, you are agreeing with the following: “I/we acknowledge that Charity Check guarantees the information contained within its database is accurate only to the extent that said information is entered into its database by its participating members.  Each member is responsible for ensuring the accuracy of the information that it enters into the Charity Check database.  Charity Check is not responsible, in any manner, for any inaccurate or unreliable information entered into the Charity Check database by participating members.  Charity Check neither approves nor disapproves of any information concerning individuals entered into its database by participating members.  Each participating member is solely responsible for making its own decision concerning the extent of its benevolent gift to any individual.  Furthermore, I (we) acknowledge that any information that I (we) retrieve from the Charity Check database is only for my (our) use and I (we) will not disclose or make public, in any manner, any information that I (we) obtain from the Charity Check database.  I (we) shall enter information into the Charity Check database concerning all individuals who seek assistance from me (us) or my (our) organization, whether the entry is an initial entry or an update to an existing record contained in the database.  Notwithstanding, I (we) shall only input information concerning any financial assistance that an individual sought for me (us) or my (our) organization and/or financial assistance that I (we) or my (our) organization provided.  I (we) shall not enter any malicious, harmful, offensive, slanderous and/or defaming information concerning any individual into the Charity Check database.  I (we) shall not enter any information concerning any individual into the Charity Check database that violates any applicable local, state and/or federal privacy or other laws.  I (we) acknowledge that we are neither agents nor employees of Charity Check and I (we) shall not represent to any individual or entity that I am an agent or employee (we are agents or employees) of Charity Check.  I (we) acknowledge that any violation or abuse of the rules and regulations of Charity Check, as determined by Charity Check, may result in immediate termination of the privileges to access the Charity Check database without any refund of any unused portion of the yearly registration fee.  I (we) and my (our) organization shall forever indemnify and hold Charity Check, its members, managers, officers, employees and agents harmless from any and all costs, damages and/or liabilities that Charity Check may, could or does incur as a result of any alleged or actual violation of the terms and/or conditions contained herein committed by me (us) or my (our) organization.  If Charity Check is subject to any claim and/or litigation as a result of my (our) alleged or actual violation and/or my (our) organization’s alleged or actual violation of the terms and/or conditions contained herein, I (we) and my (our) organization shall pay for all costs, including without limitation, reasonable attorney’s fees, incurred by Charity Check.  I (we) waive any right that I (we) may have to challenge or contest any decision by Charity Check to terminate my (our) membership as a result of Charity Check’s belief that I (we) have violated any of the terms and/or conditions contained herein.”
